Dear Sir,
We are pleased to invite you to submit your (Performa invoice) for
supplying Chemical products as per specifications and quantities in
attached tables .
So , please consider the following terms and condition C & F Misurata
sea port in EURO .
1 Delivery
The offer to be submitted in two separate sealed parts as follows:-
I. Technical file include an itemized list of the supply as indicated in
the tender quotation, general and commercial conditions, catalogues
and samples if any.
II. Financial file with an itemized price list as per the items indicated
in the technical offer.
2. Guarantee: The supplier must guarantee that the deliveries will be
of an international standard (ISO/DIN) regulation applied in this aspect.
3. Terms of payment: payment shall be effected through an irrevocable,
dividable and confirmed L/C.
3.1- (90%) (Ninety percent) payable after (30) (thirty) days from the
date of presentation of following documents:-
Original invoice
Original B/L
Original certificate of origin of good
(authenticated by Libyan peoples bureau)
Original inspection certificate
3.2- (10%) (Ten percent) payable after receipt of all materials and upon
our instructions to our bank but not latter than (3) (three) months from
the arrival date of the last lot to the destination point.
4-Bank charges: All charges outside Jamahiria shall be born and paid
by the supplier.

5-Origin of goods: must be specified clearly.
6-Packing: the goods should be packed as per the sea-worthy
standards.
7-Partial shipment: partial shipment is not allowed.
8-Delivery time: minimum time must be specified in the quotation.
9-Offer validity: should be up to 01/05/2005.
10-Inspection of the deliveries:
10.1- Inspection of the deliveries before shipping should be carried
out by a famous specialized inspecting office selected by our
company and the required cost shall be borne and paid by
the supplier.
10.2- Our Company?s representatives shall participate the
inspection process; full accommodation shall be borne and paid
by the supplier.
11-Penalty for delay: A penalty of one percent (1%) of the deliveries
delayed prices for every ten (10) days of delay. However, the total
penalty should not exceed five percent (5%) of the total price of
the order.
Such penalty (if any) shall be deducted from the (10%) (ten percent)
retention pond.
12-Compensation and replacement: If the supplier fails to fulfill his
obligations as per the conditions of this order, and it appears to our
company that the goods being delivered do not comply with the said
specification as per the terms of this order, an independent inspection
company by mutual agreement assigned will survey the claim raised
by our company and will issue a final report covering the clime raised.
Our Company will pay for this inspection if survey is in favor of
supplier other wise, supplier in this (latter) case our company will
decide necessary compensation covering the cost of the survey report .
13-The closing date: Submission of the offer shall be not latter
than 30/03/2005.

N.B.
1- Supplier must conform and repeat exactly the items in this offer
otherwise, the offer will not be considered and rejected even if the
other conditions are suitable .
2- The word "supplier" in the offer must be substituted with the
name of supplier (your name) .
3- All prices shall be on C and F Misurata-sea port in EURO.
4- Any offer received after the A / M closing date or received
incomplete will be rejected .
